Information for Victims of Human Trafficking

If negative information in your background report resulted from human trafficking, you have the right to ask SecureSearch to block it. Here is how.

Your right to have information blocked

Under the Fair Credit Reporting Act (FCRA §605C) and the Consumer Financial Protection Bureau’s rule at 12 CFR §1022.142, a consumer reporting agency may not include adverse information that resulted from a severe form of trafficking in persons or sex trafficking once you provide the required documentation.

SecureSearch is a background screening company and consumer reporting agency. We honor these requests promptly and treat them with strict confidentiality.

We will not question your experience. We will only confirm your identity, that a qualifying victim determination is included, and which items you want blocked. We will not ask you to prove the facts behind your trafficking documentation.

How to request a block

Send us a letter or email with the four items below. You may use the CFPB’s sample letter for trafficking victims, but it is not required. A representative may submit on your behalf (credit repair organizations may not).

  1. Proof of identity

Your full name (first, middle, last, suffix), any other names you have used, your current address, and your date of birth and/or Social Security number. If we cannot match you to our records, we may ask for a copy of a government-issued ID or a utility bill.

  2. Victim determination documentation

A document showing you have been determined to be a victim of trafficking, issued by any one of these:

    • A federal, state, or tribal government entity
    • A non-governmental organization or human trafficking task force member (including an affiliated victim service provider) authorized by a federal, state, or tribal government entity
    • A court, or documents filed in court that meet the rule’s standard
    • Your own signed statement that you are a victim of trafficking, if it is signed or certified by one of the entities above
  3. The items you want blocked

List the specific records in your SecureSearch report that resulted from trafficking. For example, a particular court case, charge, or date. If you have a copy of your report, you can mark the items on it.

  4. How you want us to contact you

Give us one email address or one mailing address. We will use it only to communicate about your request, and for nothing else.

Frequently asked questions

Does this apply to background check reports, or only credit reports?

It applies to all consumer reporting agencies, including background screening companies like SecureSearch. If adverse items in a SecureSearch report resulted from trafficking, you can ask us to block them.

Will you ask me for details about what happened to me?

No. We only confirm your identity, that a qualifying victim determination is included, and which items you want blocked. We do not question the facts behind your documentation.

Does it cost anything?

No. There is no charge to submit a request, and the updated copy of your report we send at the end is free.

Does a block here remove the information from other companies’ reports?

No. Each consumer reporting agency handles its own requests. You will need to contact other screening companies and the nationwide credit bureaus separately.

Can someone submit the request for me?

Yes. A representative, such as a victim service provider or attorney, may submit on your behalf. Credit repair organizations may not.
